Artist Terms and Conditions - artshow.co.nz online gallery
1. Introduction
1.1 These Terms and Conditions are treated as an agreement between NZAAT (us) and the Artist (you). By using the services provided by NZAAT, the Artist consents to be bound by these Terms and Conditions.
1.2 The New Zealand Affordable Art Trust (NZAAT) owns the website www.artshow.co.nz
1.3 The NZAAT reserves the right to change these Terms and Conditions from time to time. Such changes will be displayed on www.artshow.co.nz website and will have immediate effect. The Artist will also receive notification of the changes by email.
2. The Application Process
2.1 Artists must apply to be included on the www.artshow.co.nz website. Applications are done via the website and must contain a profile and be accompanied with 3 different images of the Artists work for submission.
2.2 Successful applicants will be notified within 14 days by email. The decision for membership approval or decline is at the sole discretion of the NZAAT.
2.3 All Applicant Artists must be over 18 years of age. Artist under the age of 18 must have approval by a consenting adult.
2.4 The Application Process is free.
3. Artist Fees / Commission
3.1 The NZAAT does not take a commission on sales.
3.2 Successful applicants will be charged $600 per year – this can be paid via regular payments on the 1st of each month of $50 per month.
3.3 There is a discount for artists who pay the full amount up front: $500 per year.
3.4 The membership fee includes GST
3.5 The membership fee must be paid in advance
3.6 There will be no refunds.
3.7 Failure to pay these fees on time will result in the removal of all artists’ details from the website
4. Artist Responsibilities
4.1 It is the Artist’s responsibility to keep their account information, profile information, and availability of artwork up-to-date and accurate at all times.
4.2 The Artist must login to the artshow.co.nz website at least once every 60 days to ensure accuracy of information and availability of work. Failure to do so may result in the Artist’s account being closed.
4.3 Artists may not upload any content or images that they do not have the Copyright ownership of, or have the legal right to sell, or any content that is deemed unlawful, harmful, abusive, obscene, pornographic, libellous, invasive of another's privacy, hateful, or otherwise objectionable.
4.4 Failure to meet these responsibilities may result in the Artist’s account being permanently removed from the Website.
5. Sales Procedure
5.1 In the event of a sale, the buyer and the artist are put in direct contact with each other to arrange payment and delivery details. The NZAAT is not involved in this procedure.
5.2 It is the Artist’s responsibility to safely package, insure and arrange for delivery of the piece, and to keep the buyer informed of any delays or necessary information for delivery.
5.3 The Artist must deliver the art work/s within 14 days to the Buyer. If there are delays for any reason, it is the Artist’s responsibility to communicate this to the Buyer
6. Non-Exclusivity
6.1 The pieces displayed by artshow.co.nz are non-exclusive and the Artist retains the right to sell or display their pieces through any other agent or dealer.
6.2 The Artist has a duty to update their Web Page regularly and if a piece is no longer available for purchase, the Artist must update the artwork status. Failure to do so may result in the Artist’s account being closed.
7. Copyright
7.1 All copyright and other intellectual property rights in the pieces displayed remain with the Artist.
7.2 Although the NZAAT shall endeavour to prevent the infringement of these rights, all pieces displayed are done so at the Artist’s own risk.
7.3 The NZAAT shall not be liable for any loss or damage caused to the Artist by the infringement of their copyright or other intellectual property rights.
8. Termination of Accounts
8.1 The NZAAT may close the account of an Artist without providing any reason or prior notice.
8.2 The Artist may close their account for whatever reason; but must give the NZAAT 14 days notice. All profile information and artworks will be removed from the site by NZAAT within 14 days. All artists details will be kept on the NZAAT’s database, the artist may request to be removed at any time.
9. NZAAT rights
9.1 The NZAAT reserves the right to edit any material on the artists web pages; excluding artwork details.
9.2 The NZAAT reserves the right to use artist images exhibited on the website for the use of promoting the artists and the online gallery.
10. Disclaimer
10.1 The NZAAT does not warrant that the information contained on this site is accurate or up-to-date. Every effort has been made to keep the information contained on this website current and factual, but this is not guaranteed. The NZAAT offers no warranties of any kind whatsoever to any site users and will not be held liable for any damages of any kind arising from the use of this website, or from use of the pieces listed on or purchased from this site.
